NOTICE OF DECISION

TAKE NOTICE That the Committee of Adjustment of the Municipality of Powassan has approved a Minor Variance application under Section 45 (1) of The Planning Act on September 25, 2018.
The Purpose and Effect of the Minor Variance is to provide relief from Section 4.5.2 (ii) of the Zoning Bylaw which requires a 30 metre front yard setback and Section 3.1 (f) which requires accessory buildings to be located in either the interior side or rear yard. A new deck will replace the existing porch and a garage will be constructed on the west side of the dwelling.
APPEALS: Any appeal to the Minor Variance must be filed with Maureen Lang Clerk of the Municipality of Powassan setting out the reasons for the appeal and the specific part of the Minor Variance to which the appeal applies together with a certified cheque or money order in the amount of $300.00 payable to the Minister of Finance. A copy of the appeal form is available from the Local Planning Appeals Tribunal website.
The decision of the Municipality of Powassan Committee of Adjustment is final if a “Notice of Appeal” is not received on or before the last day for filing a notice of appeal. The last day for filing an appeal is October 15, 2018.
Only individuals, corporations or public bodies may appeal a decision of the Committee to the Local Planning Appeals Tribunal. A notice of Appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed by an individual that is a member of the association or group on its behalf.
No person or public body shall be added as a party to the hearing of an appeal unless before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the Municipality of Powassan Committee of Adjustment, or in the opinion of the OMB there are reasonable grounds to add the person or public body as a party.
