Passing of Bylaw 2019-27-

Notice of Passing of By-law No. 2019-27
Pursuant to Section 34 of the Planning Act, R.S.O. 1990.


Take Notice that the Council of the Corporation of the Municipality of Powassan passed By-law No. 2019-27 on the 3rd day of December 2019 to amend Zoning By-law No. 2003-38, by rezoning the lands legally described as being located in Part of Lots 2 and 4, Block 3, Plan 43, described legally as Parts 1, 3 and 8, Plan 42R-21292 in the Municipality of Powassan, as shown on the attached key map.

And Take Notice that any person or agency may appeal to the Local Planning Appeals Tribunal in respect of the Zoning By-law Amendment by filing with the Clerk of the Municipality not later than the 24th d day of December, 2019, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection.  The filing fee of $300.00 must accompany the objection by cheque payable to the Ontario Minister of Finance.

And Take Notice that only individuals, corporations or public bodies may appeal a decision of the municipality to the Local Planning Appeal Tribunal.  A notice of appeal may not be made by an unincorporated association or group.  However, a notice of appeal may be made in the name of an individual who is a member of the association or the group on its behalf.

An Explanation of the purpose and effect of the by-law is provided below.  The complete Zoning By-law Amendment is available for inspection in the Municipal Office during regular office hours.

Zoning By-law No. 2019-27
Purpose and Effect

The subject lands are legally described as being located in Part of Lots 2 and 4, Block 3, Plan 43, described legally as Parts 1, 3 and 8, Plan 42R-21292 in the Municipality of Powassan (See Key Map).

Bylaw 2019-27 rezoned the subject lands from the Village Commercial One (CV1) Zone to the Multiple Residential Exception (RM-12) Zone.  The purpose of the amendment was to permit an apartment building consisting of 3 dwelling units and one accessory administration office to be located at this location.
